Neuberger Quinn obtains complete victory in terminating a decades old agreement and recovering monetary claims

Neuberger, Quinn attorneys, Elliott E. Engel and Steven Willner, successfully obtained a complete victory in the Circuit Court of Prince George’s County. The firm represented an apartment complex owner (600 units), who shares water and sewer lines with the adjoining condominium association (175 units) pursuant to a 1974 Agreement, requiring the apartment complex to first pay the full WSSC bill, and then seek reimbursement from the association. The association also refused to share in the maintenance expenses of the pipes.
On summary judgment, the Circuit Court of Prince George’s County ruled in favor of the firm’s client and determined that the 1974 Agreement terminated and that the client may cut, cap and seal their pipes. After a bench trial, the court granted judgment in favor of the client on the unjust enrichment claim in full in the amount of approximately $180,000, and rejected the association’s counterclaim.
